Terms of Service.

These Terms of Service ("Terms") govern access to and use of the website 3d4u.hr ("Site") and orders of services from 3D4U ("3D4U", "Provider", "we"). By using the Site, sending an enquiry or an order, you confirm that you have read, understood and fully accept these Terms.

1. Provider information

2. Subject

These Terms apply to all use of the Site and business relations arising from the following services:

  • 3D printing (FDM, SLA, SLS)
  • 3D modeling and CAD design
  • 3D printer service
  • Rapid prototyping and consulting

3. Contract formation

The contract is formed electronically at the moment the Provider confirms acceptance of the order (or quote) in writing (email is considered written form).

  1. The customer sends an enquiry via the Site form, email or phone.
  2. The Provider analyses the request and sends a non-binding quote with price and lead time.
  3. The customer confirms acceptance of the quote in writing.
  4. The Provider sends an order confirmation — at this moment the contract is concluded.

Before confirming an order the customer may review and amend entered details. The contract is concluded in the Croatian language.

4. Prices, payment and invoicing

  • All prices are stated in euros (EUR).
  • The Provider [is / is not] a VAT payer — status is visible on every quote and invoice.
  • Prices do not include delivery costs unless expressly stated otherwise.
  • Depending on the type and value of the work, an advance payment of up to 50% may be requested; the remainder is due before pickup/dispatch.
  • Payment is made by bank transfer to the account stated on the quote/invoice, within the stated deadline.
  • For late payments the Provider may charge statutory default interest.

5. Production time and delivery

The indicative production time is stated in the quote and starts on the day the order is confirmed and any agreed advance is received. It may be extended due to:

  • Force majeure (power outage, equipment failure, material supply disruption).
  • Late or incomplete documentation from the customer.
  • Subsequent changes to the customer's requirements.

The Provider will notify the customer of any significant delay without undue delay.

6. Materials, tolerances and quality

3D printing is an additive process with inherent technical limitations. The customer accepts that:

  • Typical dimensional tolerances are ±0.3 mm or ±0.5% (whichever is greater) for FDM, ±0.15 mm for SLA, ±0.3 mm for SLS — unless agreed otherwise in writing.
  • Visible layer lines, support-structure marks and minimal surface irregularities are technically normal.
  • Mechanical properties depend on material, print orientation and use conditions; the Provider does not warrant fitness for particular purposes (structural, medical, aerospace) unless expressly agreed.
  • For customer-supplied models the customer warrants their technical correctness (watertight mesh, orientation, dimensions). The Provider is not liable for defects that result from a defective source model.

7. Pickup and delivery

  • Personal pickup is possible by appointment.
  • Delivery is performed by the Provider's chosen courier at the customer's expense unless agreed otherwise.
  • Risk of accidental loss passes to the customer upon handover to the courier.

8. Consumer right of withdrawal

Under the Croatian Consumer Protection Act (OG 19/2022, 56/2022, 110/2023), consumers have the right to withdraw from a distance contract within 14 days without giving reasons.

Exception: the right of withdrawal does not apply to goods "made to the consumer's specifications or clearly personalised" (Art. 79(1)(3) CPA) — which includes all products made to a customer's individual model or order (custom 3D printing, 3D modeling, rapid prototyping). Service that has been started with the consumer's express prior consent (Art. 79(1)(1) CPA) also loses the right of withdrawal.

9. Complaints and material defects

Complaints are to be submitted without delay after noticing the defect, in writing to info@3d4u.hr with a description and photos. Liability for material defects follows the Croatian Obligations Act (OG 35/2005 as amended) and, where applicable, the Consumer Protection Act.

The Provider will consider the complaint and respond in writing within 15 days.

10. Intellectual property

  • All Site content (text, images, logo, code) is owned by the Provider or used under a valid licence, and is protected by copyright law.
  • Reproduction, download or distribution of content without written permission is not allowed, except for personal, non-commercial use.
  • Customer-supplied 3D models remain the customer's property. The customer warrants they hold all rights required and assumes full liability towards third parties for any infringement.
  • 3D models created by the Provider for the customer: copyright transfers to the customer upon full payment, unless agreed otherwise.

11. Limitation of liability

To the fullest extent permitted by law, the Provider is not liable for:

  • Indirect damages, lost profits or consequential damages.
  • Site unavailability due to maintenance, force majeure or technical issues.
  • Content of external sites linked from the Site.
  • Use of printed parts outside their intended purpose (e.g. safety-critical or medical applications without a specific agreement).

Total liability under any individual contract is limited to the value of the invoiced service, except in cases of intent or gross negligence.

12. Data protection

Personal data collection, processing and protection are described in the Privacy Policy. Cookie usage is described in the Cookie Policy.

13. Dispute resolution

We seek to resolve any dispute amicably. If not possible, disputes are subject to the jurisdiction of the competent court in the Republic of Croatia, under Croatian substantive law.

Under Regulation (EU) 524/2013 consumers may use the EU online dispute resolution (ODR) platform: ec.europa.eu/consumers/odr.

14. Final provisions

The Provider reserves the right to amend these Terms at any time. Changes take effect upon publication on the Site. Contracts concluded before an amendment are governed by the Terms in force at the time of conclusion.

If any provision is held void or unenforceable, the remaining provisions stay in force.
